The Four Elements of a Tort

In order for a tort to have been committed, four elements have to be in place. They are:

  • Duty. The duty of every driver is to safely abide by the rules of the road.
  • Breach of duty. This duty has been breached if the other driver does not follow the rules of the road. Driving dangerously is a breach of duty.
  • Causation. The breach of duty must have caused an injury in a reasonably direct fashion.
